Public hearing on incorporation of Edgemont continues April 24 7:30 PM Town Hall

Procedure for the Continued Public Hearing
on the Petition for the Incorporation of the Village of Edgemont
on April 24, 2017   Greenburgh Town Hall, 177 Hillside Ave
Town Supervisor Paul Feiner has decided that even though Section 2-206(1)(a) of the Village Law limits the content of comments at public hearings under Article 2 of the Village Law to objections, he wants to hear from those who wish to respond to the objections to the petition, as well. He has therefore adopted the following rules for the continued public hearing on April 24, 2017 beginning at 7:30 p.m.
1.            In accordance with Village Law §2-206(3), “[a]ll objections must be in writing and signed by one or more residents qualified to vote for town office in the Town of Greenburgh.” Therefore, anyone who wishes to object to the petition may do so without testifying at the hearing by filing a written objection with the Town Clerk. Written objections will be received until the close of the public hearing on April 25, 2017 at 12:00 p.m.
2.            Village Law §2-206(3) further requires that “[t]estimony as to objections may be taken at the hearing which shall be reduced to writing and subscribed by those testifying.” To satisfy this requirement, the stenographer will record all of the testimony at the hearing and each objector will be contacted later to subscribe his or her testimony.
3.            Persons who wish to respond to the objections to the petition may testify at the hearing as well. Persons who wish to respond to the objections to the petition may submit written statements, but are not required to do so.
4.            The purpose of the hearing is not to address whether the proposed incorporation is good or bad. That is for the qualified voters to decide if the petition is determined to be sufficient. Testimony as to the merits of incorporation will not be permitted.
5.            Anyone who wishes to speak must register with the Town Clerk. Speakers can register in advance or on the night of the hearing. Speakers will be called in the order in which they register.
6.            Speakers will be permitted to speak one time for no more than three minutes each.
7.            All those present who are not speaking must be quiet and courteous to the speakers. No one in the audience will be permitted to interrupt a speaker or otherwise disrupt a speaker’s presentation. Anyone who engages in such conduct or is otherwise unruly will be required to leave the hearing room.
The hearing will continue until 10 p.m., at which time the hearing will be concluded. Written submissions will be received by the Town Clerk , at which time the record will be closed.
