Also, listing of item on agenda is subject to time permitting to reach the item prior to the scheduled conclusion of the meeting. - Any of the above may in whole or in part be addressed in Executive Session, to the extent permitted by NYS Open Meeting Law Section 105 if voted by a majority of total membership. Requests for executive session should normally be made 72 hours before the meeting. - Board of Ethics Rule 4(j): "It is the intent of the BOE, subject to reasonable rules as it may impose, to allow the public to speak. A public comment period may be scheduled on the agenda." In an attempt to balance the benefits of pubic comments and the efficient administration of the work of the Board of Ethics, the Board will generally use the following procedure: (i) first discuss the agenda items and make tentative decisions, (ii) hear public comments during the specified time period, and (iii) after public comment, make its final decisions. From time to time, however, a member of the Board of Ethics may wish to ask a question or seek a comment from the public during the initial discussion of an agenda item. Board of Ethics Rule 4(j) also provides: "Public comment is subject to the necessary rule of avoiding excessive repetition, obstructionism or personal attacks. The Chairman or a majority of the members present may rule that a speaker is out-of-order."
